The travel agency MT EXPLORE, as data controller, pursuant to art. 13 of the European General Data Protection Regulation 679/2016 (hereinafter the “GDPR”), provides the following information regarding the processing of personal data that you, as the data subject, have communicated to us:

1. for the organization of a tour package;

2. to facilitate the purchase of linked travel services;

3. for mediation in the purchase of a tour package organized by third parties or individual tourist services provided by third-party suppliers (e.g. hoteliers, carriers,);

4. for mediation in the purchase of financial/insurance services ancillary and linked to the facilitated tour packages/services or purchased individually (medical-luggage insurance; cancellation; assistance to travelers in difficulty; consumer credit financing); and for fulfilling the task related to visa issuance;

5. for registration on our website and/or app or filling out the forms present on the website or in the app;

Purpose and legal basis of the processing.

Furthermore, among the data you provided there may be some personal data defined by the GDPR and Italian harmonization legislation as “special” (e.g. health, judicial). Sensitive/special data will be processed according to the purposes indicated below and only with your express consent.

Your personal data will be processed for the fulfillment of obligations arising from negotiations and the contract related to the organization of the tour package, or the mandate to facilitate the purchase of linked tourist services or the mediation mandate for the purchase of individual tourist services or in any case for the execution of obligations deriving from all contractual relationships, including the negotiation phase, indicated in the previous letters a) to f), in order to allow MT EXPLORE to provide the service in an optimal manner, in particular for:

• the conclusion, management and execution of contractual relationships between you and MT EXPLORE;

• responding to your requests;

• the communication of notices related to the purchased package or tourist services or other additional and ancillary services (e.g. information related to purchased tourist services; modification of contractual conditions; cancellations);

Legal purposes:

Your personal data will also be processed to:

• execute legal obligations, regulations, national, community and international standards or those deriving from provisions issued by Authorities legitimized by law; ii. ascertain, exercise and/or defend in contentious proceedings, including judicial, a right of MT EXPLORE;

• fulfill obligations provided for in tax and accounting matters;

• fulfill obligations related to traveler safety and health regulations;

• fulfill obligations related to passenger and freight transport regulations.

Business and statistical purposes:

Your personal data will also be processed for purposes related or pertinent to the activity carried out by MT EXPLORE and for the processing of anonymous statistics and market research.

Furthermore, if you expressly consent, your personal data will be processed for the following purposes:
Marketing purposes, which include:

• promotional activities of MT EXPLORE and/or commercial partners, carried out both with automated methods (e.g. e-mail, sms, instant messaging applications, etc.) and with non-automated methods (e.g. ordinary mail, telephone with operator, etc.). In particular, MT EXPLORE may use your e-mail address, provided at the time of purchasing packages or tourist services, to send you information and promotional communications related to services and products similar to those offered by MT EXPLORE and/or commercial partners even without your consent, provided that you do not object to such use.
  Commercial partners belong to the following product categories:

1. accommodation facilities;

2. airlines/shipping companies; rail carriers; road carriers;

3. travel agencies and travel agency networks;

• profiling activities, i.e. analysis of your travel preferences and market research in order to improve the offer of services and commercial information presented by us, making them more compliant with your interests. This activity may also take place through the administration of satisfaction questionnaires and/or the use of profiling cookies used during browsing on our sites and apps. The processing for Marketing Purposes (therefore both for promotional and profiling activities) can only take place with your consent.

Nature of the provision of data and consequences of a refusal.

The provision of your personal data is optional, however, in the absence of the data required for the purposes indicated in points a) and b) (purpose related to contractual and legal performance) the requested service or part of it cannot be executed, therefore you will not be able to take advantage of the opportunities mentioned above.

The provision of optional data will allow MT EXPLORE to improve the services offered in order to make them increasingly responsive to the personal interests of its customers. The provision of sensitive/special personal data is voluntary; however, in the absence of such consent, MT EXPLORE might not be able to fulfill some contractual obligations related to the processing of such data.

Categories of personal data recipients.

Your data will not be disseminated. Your data may be communicated, exclusively for the purposes mentioned above, to the following categories of subjects:

• internal staff of MT EXPLORE, as authorized personnel and/or data processor;

• to the providers of tourist services included in the packages sold, or who provide linked or individual services purchased from MT EXPLORE;

• to Insurance companies that provide ancillary and linked coverage with the purchased packages and tourist services;

• persons, companies, associations or professional firms providing services or assistance and consulting activities in favor of MT EXPLORE in order to protect their own rights

• (e.g. accountants, lawyers, tax consultants, auditors, consultants in the context of auditing or due diligence operations, etc.)

  • persons, companies, or agencies that provide marketing and analysis services or consulting activities in favor of MT EXPLORE;

  • subjects to whom the right to access your data is recognized by legal and secondary regulatory provisions or by provisions issued by Authorities legitimized by law, including airport, port, customs and border authorities.

Transfer of personal data outside the European Union.

Your personal data may be transferred abroad to third-party companies belonging or not to the European Union, always for the purposes indicated above.

In case of data transfer to countries outside the European Union, these countries will guarantee an adequate level of protection based on a specific decision of the European Commission or alternatively the recipient will be contractually obliged to data protection with an adequate level comparable to the protection provided by the GDPR.

Conservation of personal data.

Personal data will be kept for a period not exceeding that necessary for the achievement of the purposes for which they were collected and subsequently processed. Personal data will be kept for the entire duration of the contract you concluded and also for a subsequent period:

1. within the terms established by current legislation;

2. within the terms established by regulations, including secondary ones, that impose data retention (e.g. tax returns);

• within the period necessary to protect the rights of the data controller in the event of any disputes related to the provision of the service.

Personal data collected and processed for profiling purposes will be kept for a maximum period of ten (10) years at the end of which they will be automatically deleted or permanently anonymized.
